These Terms of Service ("Terms") are a binding agreement between you and Simple Safe Technologies LLC, doing business as Infinity Smart Living ("Infinity Smart Living," "we," "us," or "our"), governing your use of this website and our marketing and lead-referral services. By using this site, requesting a consultation, or submitting your information, you agree to these Terms. If you do not agree, please do not use the site.
1. Who we are and what we do
Infinity Smart Living is a marketing and lead-referral service. We advertise smart-home packages and connect interested homeowners with independent, third-party licensed electricians, contractors, and installers ("Installers"). We are not an electrical, general, or home-improvement contractor, and we do not perform any installation, electrical, wiring, mounting, programming, or other physical work. We do not hold ourselves out as a licensed contractor. All installation and service work is performed solely by independent Installers under a separate agreement entered into directly between you and the Installer.
2. Eligibility
You must be at least 18 years old and the owner of the property (or otherwise authorized to request services for it) to use our services.
3. Consultations and lead referrals
Consultations are free and non-binding. When you request a consultation, you authorize us to collect your information and to share it with one or more Installers so they can contact you, assess your home, and provide their own quote. Any layout, plan, design idea, or price that we or an Installer share is an estimate only and is not a contract. A binding contract is formed only when you and an Installer sign a separate written agreement. We may decline, reschedule, or reassign a referral at our discretion, and we do not guarantee that any Installer will contact you or accept your project.
4. Independent installers; no liability for installation work
Installers are independent third parties. They are not our employees, agents, partners, joint venturers, or representatives. We do not employ, supervise, direct, control, inspect, or guarantee any Installer or their work, pricing, scheduling, licensing, insurance, permitting, code compliance, materials, or conduct. Any contract for installation or service is solely between you and the Installer.
To the fullest extent permitted by law, Infinity Smart Living is not responsible or liable for any act, omission, negligence, workmanship, defect, delay, property damage, personal injury, death, loss, or dispute arising out of or relating to any Installer or to any installation, electrical, or service work. You are solely responsible for independently verifying each Installer's license, insurance, references, and suitability before hiring them, and for negotiating and signing your own agreement directly with them.
5. Packages, pricing, and payment
Package names, descriptions, and any prices or "starting at" figures shown on this site are marketing estimates for general guidance only and may change at any time without notice. They are not offers, and they do not account for the specific conditions of any individual home. Your final scope, price, payment terms, deposits, and schedule are set solely in the written agreement between you and your Installer. We do not collect payment for installation work.
6. Products and manufacturer warranties
Smart-home devices and equipment are made by third-party manufacturers and are covered, if at all, by those manufacturers' own warranties. Any workmanship warranty is provided by your Installer under your agreement with them. We make no warranty of any kind regarding any product or installation.
7. Calls and text messages (consent)
By providing your phone number and submitting our form, you give your prior express written consent to receive calls and text messages from Infinity Smart Living and the Installers we refer you to, at the number you provide, including by automatic telephone dialing systems, autodialers, prerecorded or artificial voice, and SMS/MMS, about your inquiry, scheduling, consultations, packages, and related offers. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. You confirm that you are the subscriber or customary user of the number provided.
8. Acceptable use
You agree to provide accurate information, to use the site lawfully, and not to interfere with or misuse it. You may not submit another person's contact information without their permission.
9. Informational content; disclaimer of warranties
Any guides, blog posts, and other content on this site are general information only and are not professional, electrical, engineering, or legal advice. The site and all content, consultations, and referrals are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any Installer will meet your expectations.
10. Limitation of liability
To the fullest extent permitted by law, Infinity Smart Living and its members, managers, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, data, goodwill, property damage, or personal injury, arising out of or relating to the site, our services, or any Installer, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility. Our total aggregate liability for any and all claims will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Infinity Smart Living and its members, managers, officers, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the site, your violation of these Terms, or your dealings or agreements with any Installer.
12. Dispute resolution; arbitration; class-action waiver
Most concerns can be resolved informally, so please contact us first. Any dispute that cannot be resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in [COUNTY] County, Florida, rather than in court, except that either party may bring a qualifying claim in small-claims court. You and we waive any right to a jury trial and to participate in any class, collective, or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.
13. Intellectual property
The content, design, logos, and materials on this site are owned by Infinity Smart Living and may not be copied or used without our permission.
14. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration section above, any dispute will be resolved exclusively in the state or federal courts located in [COUNTY] County, Florida, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. The "Effective date" above shows the latest version. Continued use of the site means you accept the updated Terms.
